Terms of Service

B2B customers and data

AirPunch is provided to companies operating ambassador and creator programs. Each customer is responsible for its program, its users, and the personal data of its ambassadors, creators, applicants, and other contacts. As described in our Privacy Policy, AirPunch processes that personal data on the customer's behalf to provide the Service.

Acceptance

These Terms of Service govern your use of airpunch.io and the AirPunch Creator Platform (together, the “Service”). By accessing or using the Service, you agree to these terms. If you use the Service for an organization, you represent that you have authority to bind that organization to these terms.

The Service

AirPunch provides an online-presence report for website visitors and a platform for organizations and their members to support business development and creator/ambassador programs. Optional Connections can help prepare meeting research, call notes, daily digests, and reply drafts. The Service prepares material for your review; it does not independently send messages, email, or make changes to your connected accounts.

Accounts and organizations

Keep your account credentials secure and provide accurate account information. Organization administrators are responsible for the members and permissions they manage. You are responsible for activity performed through your account or organization, except to the extent caused by our failure to protect the Service.

Acceptable use

You may not use the Service to:

• violate any law, regulation, or third party's rights;
• scrape or collect third-party data in violation of that party's terms;
• interfere with, probe, or circumvent the security or operation of the Service; or
• submit harmful, deceptive, or unauthorized content.

You are responsible for what you submit, connect, review, and send. AirPunch software only prepares drafts and recommendations; you decide whether and how to use them.

Your content and connected accounts

You retain ownership of the content you submit to the Service. You grant us the limited permission needed to host, process, and display it to provide the Service to you. If you connect an account or share a folder, you warrant that you have the right to do so and to direct us to access the relevant data. We act on your instructions in providing connected features. You can disconnect Connections at any time.

Third-party services

Connections may rely on third-party services, including Google, Telegram, and X. Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the availability, content, policies, or actions of third-party services. Access may change or end if a provider changes its service or permissions.

AI-assisted output

AI-generated reports, research briefs, summaries, recommendations, and drafts may be incomplete, inaccurate, or unsuitable for your purpose. Review all output before relying on it or sending it. You remain responsible for your decisions, communications, and use of the output.

Fees

The platform may include paid features. Any pricing, payment terms, and scope for paid features will be agreed separately in writing.

Intellectual property

AirPunch and its licensors own the Service, including its software, design, branding, and content other than your content. Subject to these terms, we give you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, distribute, reverse engineer, or exploit the Service except as permitted by law or in writing by AirPunch.

Termination

You may stop using the Service and disconnect Connections at any time. We may suspend or terminate access if you breach these terms, create a security or legal risk, or if we discontinue the Service. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

Disclaimers and limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that its output will be accurate.

To the extent permitted by law, AirPunch will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunity arising from or related to the Service. Nothing in these terms limits liability that cannot legally be limited.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless a written agreement between you and AirPunch says otherwise.

Changes to these terms

We may update these terms as the Service changes. We will post the updated terms here and update the date above. Continued use after an update means you accept the updated terms.
